1. Who we are and what this policy covers
NUBIGON Inc. ("NUBIGON", "we", "us") is the controller of the personal information described in this policy. Our address is 917 Saint Marks Ave, Apt 4, Brooklyn, NY 11213, USA.
This policy applies to personal information we process when you:
• visit nubigon.com and its subdomains, including gallery.nubigon.com and support.nubigon.com (the "Website");
• start a trial, buy, or manage a NUBIGON license or subscription;
• install, activate, and use NUBIGON Pro and related software (the "Software");
• contact us, submit a support ticket, subscribe to our newsletter, submit work to be featured, or interact with us at events or on social media.
It does not cover the 3D data, point clouds, models, or other project files you open in the Software. Those files are processed locally on your device and are not sent to us unless you choose to share them (for example, in a support ticket or a "Get Featured" submission).
The End-User License Agreement (EULA) and our Terms and Conditions govern your use of the Software and Website. If they conflict with this policy on how we handle personal information, this policy controls.
2. Information we collect
We collect information you give us, information generated when you use the Website or Software, and limited information from partners.
• Contact and identity information, such as your name, email, phone, company, job title, and country. You give us this through forms, support tickets, newsletter sign-ups, and quote requests.
• Order and billing information, such as the product, license type, order ID, billing address, VAT ID, subscription status, and renewal dates. We receive this from FastSpring, our reseller and payment processor. We do not receive full card numbers.
• License and activation information, such as your license key, activation and verification events, a device identifier, Software version, operating system, and IP address. The Software sends this when you activate or verify a license or use online features.
• Support and feedback information, such as ticket contents, attachments, files you choose to send, feedback, and forum posts. You give us this through the support portal or feedback forms.
• Submissions, such as images, videos, project descriptions, and credits you send us to be featured, through "Get Featured" or partner forms.
• Website usage information, such as pages viewed, referrer, browser and device type, approximate location from your IP address, and cookie identifiers. We collect this through cookies and similar tools (see section 4).
• Marketing interaction information, such as newsletter opens and clicks and ad interactions. We receive this from our email and advertising providers.
• Partner and reseller information, such as contact details of customers and prospects who buy through a NUBIGON reseller. We receive this from our channel partners.
We do not knowingly collect sensitive personal information, such as health data or government ID numbers, and ask that you do not send it to us.
3. How we use information
We use personal information only for the purposes below. If you are in the European Economic Area (EEA), the UK, or Switzerland, the legal basis for each is shown alongside it.
• To provide trials, licenses, downloads, updates, and activation. Legal basis: performance of a contract.
• To process orders, renewals, and cancellations with FastSpring. Legal basis: performance of a contract.
• To answer questions and provide support and training. Legal basis: performance of a contract and our legitimate interests.
• To verify licenses and prevent unlicensed use, fraud, and abuse. Legal basis: our legitimate interests in protecting our software and business.
• To maintain, secure, and improve the Website and Software. Legal basis: our legitimate interests.
• To measure Website traffic and the performance of our marketing. Legal basis: your consent, where required by law.
• To send newsletters and product announcements. Legal basis: your consent or, for existing customers where permitted, our legitimate interests.
• To publish work you submit to be featured, with the credit you choose. Legal basis: your consent.
• To manage reseller and partner relationships. Legal basis: our legitimate interests and performance of a contract.
• To meet tax, accounting, export-control, and other legal obligations. Legal basis: legal obligation.
You can unsubscribe from marketing emails at any time using the link in each email. We will still send service messages, such as order receipts, renewal notices, and license information.
We do not sell your personal information, and we do not use it for automated decisions that have legal or similarly significant effects on you.
4. Cookies and similar technologies
The Website uses cookies, pixels, and similar tools. Non-essential cookies are used only with your consent where the law requires it, and you can change your choice at any time by clearing the cookies for nubigon.com in your browser, which brings the cookie banner back on your next visit.
• Strictly necessary cookies run the site, the cart, and security features, and remember your cookie choice. Providers: Squarespace and FastSpring checkout.
• Analytics cookies count visits and show how pages are used. Provider: Google Analytics, loaded through Google Tag Manager.
• Advertising cookies and pixels measure ad campaigns and build audiences for ads on social platforms. Providers: Meta (Facebook and Instagram) Pixel and LinkedIn Insight Tag.
• Embedded content plays videos and shows social posts embedded in our pages. Providers: YouTube and other social platforms.
You can also block or delete cookies in your browser settings. Blocking strictly necessary cookies may stop parts of the Website, such as checkout, from working.
We honor Global Privacy Control (GPC) browser signals as a request to opt out of advertising cookies and of "sales" or "sharing" of personal information as defined by US state privacy laws.
5. Who we share information with
We share personal information only with the parties below, and only as needed for the purposes in section 3.
• FastSpring, our authorized reseller and merchant of record. FastSpring sells licenses to you, processes payments, and handles taxes and subscription billing under its own privacy policy.
• Squarespace, which hosts the Website and its forms.
• Freshworks (Freshdesk), which runs our support portal, tickets, and knowledge base.
• Mailchimp (Intuit), which sends our newsletter and product emails.
• Google, for Website analytics and tag management.
• Meta, LinkedIn, and YouTube, for advertising measurement, social features, and embedded videos.
• Email, file-storage, and productivity providers that help us run our day-to-day business.
• Resellers and channel partners, to fulfill orders and provide support to customers in their territory.
• Professional advisers, such as lawyers, accountants, and auditors, who are bound by confidentiality duties.
• Authorities, when required by law or court order, or to protect our rights, users, or others.
• A buyer or successor, if NUBIGON is involved in a merger, acquisition, financing, or sale of assets.
Our service providers may use personal information only to provide services to us. If you buy through a reseller, the reseller's own privacy policy also applies to what it collects.
6. International transfers, retention, and security
Transfers. We are based in the United States, and our team and providers operate in several countries. When we transfer personal information from the EEA, UK, or Switzerland to a country without an adequacy decision, we rely on the EU Standard Contractual Clauses (and the UK Addendum), or on a provider's certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions. You can ask us for a copy of the relevant safeguards.
Retention. We keep personal information only as long as we need it:
• Customer, order, and license records: for the life of your license plus 7 years, for tax, accounting, and license-verification purposes.
• Support tickets: 3 years after the ticket is closed.
• Trial users who do not buy: 2 years after the trial ends.
• Newsletter data: until you unsubscribe, then a suppression record so we do not email you again.
• Analytics and advertising cookies: as set out in our cookie settings, usually no longer than 26 months.
After these periods, we delete or anonymize the information.
Security. We use reasonable technical and organizational measures, including encryption in transit, access controls, and vetted providers. No system is perfectly secure. Please keep your license keys and account credentials confidential, and tell us promptly if you think they have been compromised.
7. Your rights
Depending on where you live, you may have the right to:
• access the personal information we hold about you and get a copy;
• correct inaccurate information;
• delete your information;
• restrict or object to our processing, including direct marketing;
• receive your information in a portable format;
• withdraw consent at any time, without affecting earlier processing;
• opt out of targeted advertising and of any "sale" or "sharing" of personal information under US state laws such as the California Consumer Privacy Act.
To use these rights, email info@nubigon.com or write to the address below. We will verify your request, answer within the time the law requires (usually 30 days in the EEA and UK, 45 days in California), and will not treat you differently for exercising your rights. An authorized agent may act for you with proof of authority. If we decline a request, you may appeal by replying to our decision.
If you are in the EEA, UK, or Switzerland, you may also complain to your local data protection authority.
8. Children
The Website and Software are made for professionals and are not directed to anyone under 16. We do not knowingly collect personal information from children. If you believe a child has given us information, contact us and we will delete it.
9. Changes to this policy
We may update this policy as our services or the law change. We will post the new version here with a new "Last updated" date. If a change is material, we will also notify customers by email or on the Website before it takes effect.
